(Please note that if the start date and the billing date are different, a pro rata fee may apply)1st of the Month15th of the Month25th of the MonthI understand that this contract will convert to a month-to month contract after 3 month. *YesDURATION 2.1 This Agreement shall commence on the Effective Date and shall endure for a minimum fixed period of three (3) consecutive calendar months (“Initial Period”). 2.2 During the Initial Period, the Student may not cancel this Agreement without incurring the full fees payable for the balance of the Initial Period as a reasonable cancellation penalty. 2.3 Upon expiry of the Initial Period, this Agreement shall automatically continue on a month-to-month basis (“Renewal Period”), unless terminated by either Party in accordance with clause 2.4 below. 2.4 Notice of Cancellation 2.4.1 After expiry of the Initial Period, either Party may terminate this Agreement by giving the other Party at least one (1) full billing cycle’s written notice, calculated from the Student’s scheduled monthly debit order date (“Billing Date”). 2.4.2 A notice of cancellation received before the Student’s Billing Date shall take effect from that Billing Date, the Student shall remain liable for all fees payable for the full billing cycle following that Billing Date. 2.4.3 A notice of cancellation received on or after the Student’s Billing Date shall be deemed to have been received only on the next Billing Date, and the Student shall remain liable for all fees payable for the full billing cycle following that next Billing Date. 2.5 The Studio shall continue to make the Services available to the Student during the Notice Period and, whether or not the Student makes use of the Services, the Student shall remain liable for all fees payable during the Notice Period. 2.6 The Student acknowledges and agrees that this Agreement may not be suspended, paused, frozen or placed on hold for any reason whatsoever, whether during the Initial Period, the Renewal Period, or the Notice Period. The Student shall remain liable for all fees payable in terms of this Agreement notwithstanding any illness, injury, holiday, travel, work commitments or any other circumstances preventing the Student from attending Classes. Notwithstanding the above, the Studio may, at its sole discretion, permit a temporary suspension in exceptional circumstances, which shall not constitute a waiver of this clause. Clause 2.4 Upon lapsing of the Period and in the absence of a written notice of cancellation required in terms of clause 2.2 above, the Agreement shall continue on a month-to-month basis until cancelled by either Party in terms of the said clause 2.2.I understand that there is a strict cancellation policy on all classes. *YesRESCHEDULING OF CLASSES BY STUDENT 5.1 The Student may cancel or reschedule a booked Class without penalty provided that: 5.1.1 for any weekday evening Class, such cancellation or rescheduling is made at least eight (8) hours prior to the scheduled start time of the Class; and 5.1.2 for any morning or weekend Class, such cancellation or rescheduling is made at least twelve (12) hours prior to the scheduled start time of the Class, Any cancellation or rescheduling made outside of the timeframes set out above, or failure to attend a booked Class for any reason whatsoever, shall result in the Class being forfeited and deemed to have been used, with no refund, credit or extension granted. 5.2 The Studio shall after receiving the aforesaid notice and at its sole discretion, reschedule the Class to a next available date and time; subject thereto that the Class shall only be capable of being rescheduled to a date not succeeding the immediate following week in which the Class was initially scheduled. 5.3 The Student shall be entitled to reschedule no more than 2 (two) Classes per month. Whether or not a cancelled Class is rescheduled, any cancellation outside the permitted notice period shall be deemed forfeited and shall count towards the monthly reschedule limit. 5.4 In the event that the Student: 5.4.1 misses a Class without having provided the requisite notice in terms of clause 5.1 above; or 5.4.2 fails to reschedule a Class as required in terms of clause 5.2 above; or 5.4.3 reaches the limit of rescheduled Classes prescribed in clause 5.3 above; or 5.4.4 does not timeously book a Class as required in terms of clause 4.5 above; or 5.4.5 arrives more than 15 minutes late for a Class; or 5.4.6 is asked to leave the Premises due to her failure to comply with the Studio`s rules as stipulated in clause 6 below, the Student shall forfeit the Class and shall not be entitled to a refund of the fees paid for that Class or any form of credit entitling the Student to an additional Class. 5.5 Group Classes may be cancelled by the Studio if fewer than two (2) Students have booked. In such event, the Student shall be entitled, at the Studio’s discretion, to move that booking to a next available date and time, provided that such rescheduled Class is attended within the same calendar month in which it was originally booked.
